Terms of Service

Please read these Terms and Conditions carefully before booking or using TBD Photo Booth, LLC's services. By booking and utilizing our photo booth services, you acknowledge and agree to these Terms and Conditions.

I. Services

TBD Photo Booth, LLC ("Provider," "we," "us") agrees to provide photo booth rental services as described in the booking confirmation. Services include equipment setup, operation by a trained attendant, and breakdown after the agreed rental period.

II. Booking & Payment

A 50% non-refundable deposit is required to reserve your event date. The remaining balance is due prior to the event. Bookings are not confirmed until the deposit is received. We accept payment via credit card, ACH transfer, or other methods specified at booking.

III. Cancellation & Rescheduling

If the Client cancels the booking:

  • More than 30 days before the event: deposit is forfeited but no additional fees apply.
  • Within 30 days of the event: 100% of the total booking fee is due.

Rescheduling requests made more than 14 days before the event will be accommodated subject to availability at no additional charge. Rescheduling within 14 days of the event may incur a $150 rescheduling fee.

IV. Client Responsibilities

The Client agrees to:

  • Provide a suitable space for the photo booth setup (minimum 6×8 ft, access to a standard 110V electrical outlet within 25 ft).
  • Notify us of any venue-specific requirements (loading dock access, insurance requirements, noise restrictions) at least 7 days before the event.
  • Ensure that guests treat the equipment with reasonable care. The Client is responsible for damage caused by guests.
  • Provide accurate event timing so we can plan setup and breakdown accordingly.

V. Equipment & Liability

The Provider will take all reasonable precautions to ensure equipment is operational. In the unlikely event of equipment failure, our liability is limited to a pro-rated refund for the time the booth was non-operational. We are not liable for indirect, incidental, or consequential damages.

The Client agrees to indemnify and hold harmless TBD Photo Booth, LLC and associated personnel from any claims or legal fees arising from the event unless caused by the Provider's negligence.

VI. Photo Rights & Privacy

Photos taken at events may be used by TBD Photo Booth, LLC for portfolio and marketing purposes unless the Client requests otherwise in writing prior to the event. Guests retain the right to their own likeness. We will not sell or distribute identifiable photos to third parties.

VII. Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond their reasonable control, including natural disasters, government actions, or other events of force majeure. In such cases, we will work with the Client to reschedule at no penalty.

VIII. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Washington. Any disputes shall be resolved in the courts of Kitsap County, Washington.

IX. Entire Agreement

These Terms and Conditions, together with the booking confirmation, constitute the entire agreement between the Provider and the Client. Any modifications must be made in writing and agreed upon by both parties.
